Welcome to Tucia. These Terms of Service ("Terms") govern your use of our website and services ("Services") and form a binding agreement between you ("you", "user", or "customer") and Tucia ("we", "us", or "our").

By using our Services, you confirm that you’ve read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Scope of Service

Tucia offers image editing services combining human expertise and AI-powered tools. Services may include retouching, enhancement, restoration, object removal/addition, and background manipulation. Turnaround time and credit usage are shown before you place an order.

We reserve the right to reject submissions at our discretion, including but not limited to inappropriate, illegal, or technically unsupported images.

2. Image Ownership & Usage Rights

You retain full ownership of the original images you upload. By submitting content, you grant Tucia a limited, non-exclusive license to use, store, and process your files solely for the purpose of fulfilling your order.

We will never share or publish your images without your explicit written permission.

3. Prohibited Content

You are fully responsible for all content you upload. While Tucia accepts legitimate adult, boudoir, or intimate portraits for editing, you may not submit any material that violates laws, infringes on others’ rights, or poses a security, ethical, or reputational risk to Tucia. Prohibited content includes, but is not limited to:

  • Illegal content: Any material that could give rise to civil or criminal liability under applicable law, including:
    • Any material involving minors in a sexual, suggestive, or exploitative context (real or simulated);
    • Non-consensual content, including voyeurism, hidden camera footage, or revenge images;
  • Degrading, dehumanizing, or excessively violent imagery: This includes content that portrays humiliation, abuse, psychological harm, excessive pain, gore, or any material designed to shock or disturb.
  • Infringing or unauthorized content: Any material that violates privacy rights, publicity rights, copyrights, or other intellectual property rights, unless you have explicit permission from the owner of those rights and all identifiable people in the images (or their legal guardians, where applicable).
  • Abusive or harmful content: Material that is threatening, defamatory, abusive, harassing, or promotes bigotry, racism, hatred, discrimination, or physical or psychological harm against any individual or group.
  • Fraudulent or misleading activity: Content submitted from a false, anonymous, or misleading address or identity; use of bots or scripts to mass-upload or automate requests is strictly prohibited.
  • Malicious software: Files containing viruses, malware, or any code intended to damage, interrupt, or compromise the functionality of any software, hardware, or telecommunications equipment.

Tucia reserves the right to reject or remove any content at our sole discretion. Submitting prohibited content may result in immediate suspension or permanent termination of your account and, where applicable, may be reported to law enforcement.

4. Delivery & Revisions

We aim to deliver edited images within the timeframe shown during checkout. Actual delivery time may vary due to complexity, queue volume, or clarification needs.

You may request free revisions within 14 days of delivery. Revisions must be consistent with your original instructions. Requests for major changes may require additional payment.

5. Refunds

In the event of dissatisfaction, subject to the restrictions described below, we will provide a partial or full refund of your payment based on your request.

The refund policy applies up to 14 days after an order is marked as closed , whether by your explicit approval or by automatic closure if no response is received. Within this 14-day period, you may request a partial or full refund based on your level of dissatisfaction.

Refund requests submitted after the 14-day window are no longer covered by our standard refund policy, but may still be considered on a case-by-case basis and are not guaranteed.

6. File Storage & Deletion

We store your original uploaded images and final edited versions on our servers for 180 days . After that, high-resolution files may be automatically deleted. However, low-resolution preview thumbnails may be retained beyond this period for reference purposes unless you request deletion.

You may contact us at any time to request full deletion of your submitted or edited images, including thumbnails. Once deleted, files will no longer be accessible through your account or ours.

Please note: Due to the nature of cloud storage systems and ongoing backup procedures, residual copies may persist temporarily in secure, private archives . These are not publicly accessible and are not indexed or reused in any way.

7. Account & Security

You are responsible for safeguarding your account credentials. You agree to notify us immediately of any unauthorized access. Tucia is not liable for loss due to unauthorized activity unless caused by our negligence.

8. Payment

All payments are processed through trusted third-party providers (such as Stripe or PayPal). Tucia does not collect or store your payment credentials directly, and we do not have control over the outcome of each transaction.

Please be aware that payment failures may result from a variety of external factors, including but not limited to: bank-specific policies, card restrictions, currency limitations, country-based access controls, or automated risk assessments imposed by the financial institutions involved. These systems operate independently of Tucia and are subject to change without notice.

Tucia is not liable for delays, rejections, or errors arising from these external payment systems. If a transaction fails, is declined, or is unexpectedly flagged, we recommend contacting your bank or payment provider directly for further assistance.

9. Suspension, Termination & Re-registration

Tucia reserves the right to refuse, suspend, or terminate access to our Services at our sole discretion, with or without prior notice. This may include, but is not limited to, violations of these Terms, abuse of revision or refund policies, suspicious activity, or unauthorized use of promotions.

Users whose accounts have been terminated are not permitted to create new accounts under the same or different identities without our explicit written permission. This includes attempts to bypass new user restrictions through repeated sign-ups using alternate emails, payment methods, or identities. If we determine that multiple accounts belong to the same individual—through visual, technical, or behavioral matching—any associated discounts or benefits (such as new user offers) may be revoked and the accounts subject to suspension.

Participation in our affiliate or referral program is also subject to fair use. Self-referrals or attempts to manipulate the program (including creating multiple accounts to generate referral commissions) are strictly prohibited. In such cases, Tucia reserves the right to cancel associated commissions and terminate access to the affiliate program without notice.

10. Limitation of Liability

To the fullest extent permitted by law, Tucia shall not be liable for:

  • Loss of files, revenue, or business resulting from service delays or interruptions;
  • Residual file storage beyond deletion requests due to cloud architecture;
  • Indirect, incidental, or consequential damages arising from your use of the Services.

11. Privacy

Your information is handled according to our Privacy Policy . We never sell your data or share your files without explicit consent unless required by law.

12. Governing Law

These Terms are governed by the laws of British Columbia, Canada. Disputes shall be resolved through arbitration or in the courts of British Columbia, unless local laws require otherwise.

13. Changes to These Terms

We may update these Terms periodically. The latest version will always be available on this page. Your continued use of our Services constitutes acceptance of any changes.
